ScrapthePork network wants the people to go to Luneta on August 25 to protest against pork. Much as I want to go there, but the issue now is beyond the misuse of pork.
People must now militate against the unconstitutional use of Power.
Besides, why are they getting signatures for charter change? This is a dangerous thing. I am extremely doubtful about their real intentions--they want to use the people's initiative as a way to change the charter. That jibes with the palace intention of tickering with the Charter.
I think this group will just use these signatures to justify what the palace has been shouting about--the people's alleged demand for a second term for the president.
What well-meaning groups should protest about is the plan of the palace to get more power to perpetuate themselves in power. That is the issue right now.
Whatever some people say--that the President's pronouncement that he is open to another term is just a ruse--I still say that it is the duty of everyone to stand up and count himself in opposition of this very infantile thought.
Someone tried to assuage my feelings by saying that every President does that: announce that he is running again or is salivating for another dig at Power at the very end of his term to avoid the perception that he is now just a lameduck president.
How serious is the president in claiming for another term? His public announcement mocked the very words of his spokesmen and even his siblings, Kris Aquino and Balsy who even said that when the President did the SONA, he was practically saying goodbye or was on the verge of preparing for a valedictory address.
If President Aquino pursues this ridiculous and highly dangerous thought, this idea of a second term thru a cha-cha, there is actually no more time to do just that. For one, Congress will be busy discussing the five impeachment complaints lodged against Aquino. While mulling on whether those complaints are sufficient in form and substance, Congress will likewise do its primary job of reviewing the proposed nearly 3 trillion national budget.
Some believes that the President is just playing a game or put forth what many say is a red herring. The palace has successfully convinced the media to shift their attention from the anomalous DAP to other issues. Malacanang is trying to distract the public so that their attention is focused on other things rather than the anomalous disbursement acceleration program.

Senate probe on DAP--it's like a briefing

The hearing even turned Abad into a "witness", with Senate president Franklin Drilon acting like a defense counsel. I can't describe Senators Antonio Trillianes IV and Bam Aquino as "counsels". They were more like choir boys, who sang Hallelujahs every single time Abad opens his mouth and when Drilon shares his perversion before the very eyes of millions of televiewers and radio listeners.
Yes, Abad used History as defense and likened DAP (to my mind) to a prostitute---she was used repeatedly by several presidents, so, why would we be different? It's like saying that an old and wrongful act, when repeated several times over, becomes legal in the eyes of those who do it.
Abad just provided ammunition to law-breakers in this land, particularly smugglers---continue your smuggling ways and eventually, your act will become custom, therefore, legal. Or jueteng lords--continue your jueteng ways, and eventually, government will intervene and legalize everything.
What has happened to our sense of propriety, of Rightness and of adherence to the Rule of Law, when the very ones expected by the People to follow it, are themselves tearing apart every, single shred of these democratic principles?
Are we now saying that the Power of the Purse, which is given to Congress as a form of check and balance, now lodges in the Executive? Logical if you think about it. Right now, there is no more separation between the Executive and Congress, since the Executive has become a tool of politicians in their desire to advance their personal interests.
We claim to be "democratic", when the very ones occupying the Palace think of themselves as more learned than the 200 plus legislators elected by the people.
Lawyer Romy Macalintal is correct---let's abolish Congress since these Congressmen and Senators are useless. Sans the power of the purse, what powers do Congressmen are left with?
Why do we even go thru the budgetary deliberations process when, eventually, the Executive will order his henchmen to generate "savings" in order for those funds to be used elsewhere?
This practice mocks the very democratic and republican character of the State, when eventually, it is the Executive that wields not just police powers, but the Power to toy with the funds of this land?
It is that reason why we, the People, went to EDSA twenty five or so years ago--the realization that one man controls all levers of governance.
Haven't we forgotten that the main thing which sparked this thing called EDSA revolution was our anger against one man's control of the people's funds? That he once arrogated not just the Power to create laws but the Power to use the people's monies for his own personal interests?
Now, we see this country being run by a group of people who think of themselves as more learned, more conscientious and more upright than the rest of the 100 million souls in this land.
If we like this system, then, institutionalize it. If we think that there should be one body that determines where those trillions of pesos would go, then, why not change the Charter to reflect it?

Drunkards manning Malacanang? What course will the country go when drunks steer tuwid na daan?
We all know what happens at Bahay Pangarap. Yes, that place is literally a house of "dreams". Some people say it has turned into a beerhouse.
Not surprising since those in the palace like nothing more than drink themselves practically to dreamland.
During the time of former president Erap Estrada, the official time in the palace starts at 1pm and onward through past midnight.
What differs now is that at least in Erap's time, the spirits just stays in their stomachs, not in their heads.
Today, we now have drunkards who are not just lovers of Johnnies and wines and single malts--they think themselves as Kings who lord it over Philandia.
They think that they own this country, that they can twist the laws for their own sakes, and get away with it.
Those spirits must have been brewed by malevolents because those in palace are now drunk with power.
How the hell will you explain their refusal to at least respect the decision of a co-equal branch of government? The Supreme Court decided that their hair-brained idea to reward friends and demolish foes called DAP or Disbursements Against Protestors, err, Disbursement Acceleration Program is unconstitutional. The most decent thing to do is acknowledge the wisdom of the Court while maintain a belief that the DAP is not a thing that went beyond the contemplation of the Constitution.
Instead, like a drunkard is expected to do, the President himself went public and chastised a co-equal branch like a Hitler damning the Parliament to hell. We know what happened to Hitler. Hitler was not just drunk with power--he eventually lost his mind.
I don't wish this President to lose his but what he is doing now threatens the very democracy he is supposed to protect.
Rule of law is a pillar of this democracy. How will people now render every decision of the Courts when the No. 1 Citizen of the land refuses to acknowledge their wisdom?
Democracy is anchored on the concept of respect among branches of government. The very reason why the Founding Fathers contemplated on breaking government into three coequal branches is for the prevention of tyrannical rule.
Equilibrium is maintained by every branch respecting acts of other branches. How will this be now that the Chief Executive distributed public funds like those funds are his?
As the band Who sang, " we don't get fooled again".
Judicial review is a power longed with the Supreme Court and other courts, according to the Constitution. This power is given to the Courts so that acts in excess of jurisdiction or the lack of authority of another branch are reviewed and are following the Constitutional guidelines.
What the Supreme Court does is for everyone to respect and follow the law. The law is the ultimate equalizer. If we don't respect the law, how then will everyone conduct themselves now, with anarchy?
Absence of law leads to anarchy and tyranny. Disrespect of the laws means anarchy. Control of the levers of the state only shows tyranny.
This bunch of drunkards now controlling the Executive are now full of malevolent spirits in them that they refuse to pay homage to the Law and instead, be the Law themselves.
Worse, the Chief Executive himself threatened a coequal branch with destruction should the Tribunal still refuses to "toe the line" with them? What else do we describe such behavior but unbridled tyranny?
Who is now in control of Malacanan? Where else will we go when the very ones steering the country's ship are drunk with illusions of power?

Impeachment complaint jump starts ouster moves against Pnoy
Three things that really infuriated everyone regarding the DAP issue. The first one, the seemingly callous stance of Aquino himself, protecting his buddy, Butch Abad. Abad, who is tagged as the architect of the DAP, is incommunicado. His publicists say he's busy creating ways and means to probably insert DAP-like microcreatures in the proposed 2015 budget, or so they say. Several members of civil society have asked Abad to resign for decency and face the consequences of his acts. Of course, the former Congressman refused.
Now, even this is not an option anymore. Even if Abad resigns right now, that will not stop the tsunami of the people's anger against this administration.
The second thing is how the Communication team mishandled every single thing now. Malacanang's spokespersons, two of them officers themselves of the court, tried to divert the issue and even raised the eradication of the Judicial Development Fund (JDF). Of course, they failed. Worse, they allowed the President to address the nation, reading a script that was full of holes and false hyperboles and white lies that further enflamed the people. Aquino even appeared like an idiot, calling for his Yellow Brigade instead of calling for unity of forces. Shortly afterwards, the Communications secretary himself, Sonny Coloma, downplayed and even encouraged people not to put serious thought on what his principal, the Chief Executive himself, told millions of Filipinos in that bolched nationally televised speech.
The last thing that really pissed everyone off is how the President refuses to admit he committed wrong and continues to exhibit tyrannical tendencies. He even invoked the spirits of his parents while forgetting really what they sacrificed their lives for.
In his speech, the President says he will sacrifice his life for what he believes is right, the very same patriotic act his parents did. What we all know is that the reason why Ninoy came back and bravely faced the lethal bullet was his righteous indignation against one person's dictatorial streak. One man wants to be the no. 1 law maker and implementor, so that he can play with the people's monies.
Pnoy is doing what his parents hated. Pnoy is toying with the people's monies the very same way Marcos did when the former dictator was still in power.
As they say, when someone is drunk with power, how will he be able to steer the government into a "tuwid na daan"?
No more dictatorships, except that of the People.

Constitutional crisis nakaamba bunga ng palyadong argumento ni Pnoy
Tila isang banta ang ginawa ng Pangulong Aquino nang kanyang ipinagwasiwas sa mukha ng milyong-milyong Pinoy ang kanyang palyadong palusot hinggil sa Disbursement Acceleration Program.
Simple ang palusot ng Pangulo:
1. Nasasa batas ang paggamit ng "savings" o "ipon" sapagkat ang pinagbatayan ay ang Executive Order 292 o Administrative Code of the Philippines.
Ang koda na ito ay ginamit bilang basehan ni Pangulong Corazon Aquino upang maging lehitimo ang kanyang pamamahala pagkatapos ng 1986 EDSA revolt. Kung babasahin, ang buong koda ay xerox copy ng dati ang probisyon ng 1972 Constitution na siyang naging basehan ng Marcos regime.
Batid ng lahat ng nag-aaral ng batas na hindi na ito kinikilala bilang batas sapagkat mayroon nang 1987 Constitution. Sa hirarkiya ng batas, kung hindi pinahihintulutan ng Saligang Batas ang isang aksyon, malinaw itong iligal o unconstitutional.
At kung babasahin din ng masusi ang probisyon ng section 39 ng nasabing Executive Order, maaari lamang gamitin ang ipon panakip sa mga programang nakasaad na rin sa General Appropriations Act na nagkaroon ng depisito o pagkukulang sa pondo.
Karamihan sa pinondohan ng DAP ay walang ispesipikong alokasyon sa General Appropriations Act.
2. Kung nagkamali man ang palasyo, ito ay hindi pagkakasala sapagkat ginawa ito ng may mabuting intensyon
Nagbigay ng halos 2 bilyong piso sa Moro National Liberation Front ang pamahalaan. Mabuti o hindi? Hindi baga kalaban ng pamahalaan ang MNLF? Para na ring pinondohan ng pamahalaan ng pambili ng bala ang mga rebelde pampatay sa mga sundalong nakikihamok sa mga grupong ito sa Mindanao.
Nagbigay rin ng pondo sa Cordillera People's Army ang pamahalaan. Ito ba ay mayroong alokasyon sa GAA? Wala.
Sa pagbigay ng pondo sa mga armadong grupong ito, ano ang mabuting intensyon duon? Ang maging financier ng mga rebeldeng grupo para maipampatay sa mga sundalo?
3. Nauwi sa maganda ang pag divert ng pondo sapagkat bumuti ang ekonomiya
Kabalintunaan. Bumuti ang ekonomiya sapagkat lumakas ang konsumo. Lumabas ang konsumo sapagkat mababa ang interest rate ng Bangko Sentral ng Pilipinas, na umengganyo sa karamihan upang magkaroon ng sariling business. Sa pagdami ng business enterprises, nagkaroon ng trabaho ang mga Pilipino. Ginagastos ng Pilipino ngayon ang pinagmulan ng kanilan sweldo.
Bumuti rin ang ekonomiya bunga ng pambansang badget sapagkat kinunsumo ito sa loob ng ekonomiya.
Ngayon, tila hinahamon ng Ehekutibo ang Hudikatura na baguhin ang kanilang pagpapasya sa DAP. Batid nating walang police powers ang Hudikatura, at kung magiging parang goon ang Ehekutibo, sinisira nito ang equilibrium o balance of powers ng ating estado.

Kahanga-hanga si Pangulong Aquino. Tila yata kumbinsido ang pangulo na ang ginawa nilang diversion of funds ay isang legal na paraan upang sagutin ang ilang suliranin sa pondo ng ilang programa de gobyerno. Handa pa si Pnoy na makipag-away na muli sa Korte Suprema para lamang maipaglaban ang kanilang tingin hinggil sa kanilang ginawa.
Muling inihirit ni Pnoy ang section 39 ng Executive Order no. 292 na nagsasabi at ating i-quote dito na:

Pansinin ang probisyong ito...
"...any savings in the regular appropriations authorized in the General Appropriations Act for programs and projects of any department...may, with the approval of the President, be used to cover a deficit in any other item of the regular appropriations.."
Ang ibig sabihin lamang nito ay maaaring gamitin ng Pangulo ang "savings" o ipon mula sa regular appropriations mula sa anumang departamento at gamitin ito upang ipantakip sa "deficit" o pagkukulang sa ano? sa ibang item sa regular appropriations.
Malinaw sa batas na maaaring gamitin lamang ang ipon mula sa ibang departamento panakip sa pagkukulang sa pondo ng ibang programang nakasaad na rin sa GAA.
Hindi maaaring gamitin ang "ipon" o "savings" sa anumang walang appropriation.
Halimbawa, may ipon ang DILG ng isang bilyong piso. Maaaring gamitin ito ng Pangulo sa pantustos halimbawa ng kulang sa health program ng DOH kung ang programang ito ay nakasaad na rin sa GAA o General Appropriations Act.
Iba ang nangyari sa DAP.
Ayon na rin sa mga nakatanggap, ipinantakip ang mga ipon sa ibang programang hindi nakasaad sa GAA. Sa totoo, ipinapasaad nga ng Senate president Franklin Drilon sa mga senador na nabigyan ng DAP ang mga programang nais nilang pondohan. Ibig sabihin nito, wala sa GAA ang mga programang napondohan ng DAP.
Kung walang alokasyon mula sa isang batas, at ito ay GAA, hindi ito maaaring mapondohan mula sa ipon ng pamahalaan o implementing agencies.
Kung nai-divert o naibigay sa ibang paraan ang mga pondo, mayroong malaking pagkakamali at paglabag sa mga probisyon ng plunder o pandarambong ang nagkamaling opisyales.
Kaya naman, maski ang alibi o palusot ni Pnoy, palyado.

When "A" man turns Bad, it is all about Public Money
Why is it so hard for the President to do what is right? Many people are asking why it takes so hard for Noynoy to fire Butch Abad. Is it because the President is personally convinced that Abad did nothing wrong?
If that is the case, then, we are dealing with a different Noynoy because when he was Senator, this Disbursement Acceleration Program or DAP was the one he opposed and even filed a Senate resolution about. Noynoy the Senator opposing DAP and now, President Noynoy, convinced of its necessity?
If this is also the case, then Noynoy has just shown his dictatorial tendencies, the very character that his parents opposed and laid down their lives with. Noynoy is supposed to be a democrat. As a democrat, he is supposed to follow the very laws which allow democracy to thrive. And he is supposed to believe in this "ideology" called liberal democracy being pursued by his own party. Don't tell me that democracy stops when funds are concerned? That the President should be liberal in dealing with the people's monies--that he can do whatever he wants with it?
This is exactly what is terribly wrong with the President right now. We need someone who will not see things in just one perspective.
As President, Noynoy is supposed to dispense justice equally, not selectively. The Rule of Law must be upheld at all times. How then can we have a Rule of Law, when the very "Rule" interpreted by our very own President is a rule based on friendships and blood relations?
With just one swipe of his pen, Noynoy has just allowed legalized a dictatorship.
Why did we oppose the dictatorship in the first place? Because many realized that the former dictator used the people's monies for his own personal use.
Malacanang has constantly maintained the position that those billions of DAP funds went to good use. How will that happen when those funds went directly to NGO's funded and invented by Janet Lim-Napoles?
Malacanan wants Senators to prove that those funds they gave those legislators were put to good use. How will that happen when Benhur Luy himself said that Napoles dipped her fingers into this program good nature-ly?
Butch Abad is a good man, but good men are just as good as their latest act. It is so easy to be "bad" and what happened to Butch is what is happening to the rest of the good natured men working in government--they turned their "a" performance into "a-bad" one when funds are concerned.
It is so easy to have and fight for visions but when someone's vision gets blurred whenever they see money and monies at a minute's point of dispensation without any hint of responsibility, that becomes a problem.

As President, Noynoy is supposed to dispense justice equally, not selectively. The Rule of Law must be upheld at all times. How then can we have a Rule of Law, when the very "Rule" interpreted by our very own President is a rule based on friendships and blood relations?
With just one swipe of his pen, Noynoy has just allowed legalized a dictatorship.
Why did we oppose the dictatorship in the first place? Because many realized that the former dictator used the people's monies for his own personal use.
Malacanang has constantly maintained the position that those billions of DAP funds went to good use. How will that happen when those funds went directly to NGO's funded and invented by Janet Lim-Napoles?
Malacanan wants Senators to prove that those funds they gave those legislators were put to good use. How will that happen when Benhur Luy himself said that Napoles dipped her fingers into this program good nature-ly?
Butch Abad is a good man, but good men are just as good as their latest act. It is so easy to be "bad" and what happened to Butch is what is happening to the rest of the good natured men working in government--they turned their "a" performance into "a-bad" one when funds are concerned.
It is so easy to have and fight for visions but when someone's vision gets blurred whenever they see money and monies at a minute's point of dispensation without any hint of responsibility, that becomes a problem.

Senator Juan Ponce-Enrile going to Camp Crame
Senator Juan Ponce-Enrile has just left his Dasmarinas Makati residence with a convoy of about six vehicles. Enrile decided to surrender to CIDG chief Benjamin Magalong. The Sandiganbayan has ordered his arrest following the court's findings that the case filed against Enrile has merit.
Enrile is one of about twenty senators charged with profitting from the PDAF and DAP. Enrile's Chief of Staff, Gigi Reyes, was likewise ordered arrested.
The octogenarian senator has declared earlier that he is willing to voluntarily surrender to the authorities the minute the Sandiganbayan 3rd division issues a warrant for his arrest.
Jack Enrile, my good friend and Katrina, her sister tried but failed to persuade their father for them to accompany him to Crame.

On the Disbursement Acceleration Program--put to good use? Ya, right!
The palace wants us to accept the fact that those DAP funds were put to good use. Well, I doubt it. For one, Malacanang says nothing wrong with re-challenging those funds to other uses. The only disturbing thing about this is the fact that when they re-channeled the funds, those given to at least five senators went directly to the bogus NGOs of Janet Lim-Napoles.
So, there's nothing bad there? It is presumed that when funds go to Napoles' NGOs, surely, these funds financed ghost projects because Napoles was in the business of processing the papers of bogus NGOs.
The least that Malacanan should do is to let go of Butch Abad and fire all their legal experts.

Supreme Court is expected to rule DAP as unconstitutional yet "not ground for Pnoy's impeachment"?
Several wagging tongues reveal that the Supreme Court is likely to issue a decision by this week, ruling the DAP as "unconstitutional". Meaning, the very concept itself runs contrary to the stated principles of the Filipino people as expressed in the 1987 Constitution, and which means that one cannot enforce it.
Now, since the SC has ruled on its constitutionality, what happens then to the billions which the Aquino administration spent all in the name of DAP?
Will the SC ask government to recover all these funds back? What happens to those who engineered DAP? What happens to those who took part in its implementation?
What happens to the brains behind the DAP? Will these people escape this issue unscathed?
Yes, says these political tsimosos and tsismosas. The SC will say to Pnoy, " what you did is illegal", yet will also say, " For now, we will forgive you and call it quits. So what if you did was illegal? You did not know it anyway. So, you're clean and you cannot be impeached."

Aquino's vacillating thoughts about pork
When this pork barrel issue broke out, the Palace was quick to the draw---nothing bad about it, since people are benefitting from it.
Now, it seems that even the palace feels that the entire pork barrel system is bad for the nation's health. Yesterday, President Aquino felt insulted when groups called him the "pork barrel king".
Okey if he's called a "lady's man", or a "video game freak"--just don't call him a pork barrel "king", which, to my mind, sounds like the President is some kind of a "king" of a porno film.
The palace is obviously going in the other direction, even themselves avoiding the term "pork" and using the term " savings". It's savings, then, free to do whatever we want. Wrong.
Malacanan is really missing the point in this scandal. What the public is angry about is the perception that their monies are just being used and its use abused by government, or being used in a cavalier fashion by government. They are not concerned with terminologies. Whether it's "savings", "pdaf" or "DAP", the public is angry that the government is just toying with these funds which they give to the government from the sweat of their brows.
Pinagpaguran, binababoy at pinaglalaruan lamang ng mga politiko. This is the core issue.
Now, what the palace is doing is using deflection as a strategy. Imagine, Aquino is pointing out that his predecessor misused a trillion pesos. So, what are you saying Mr. President? That what you did with our 72 billion pesos is just a fraction of what Arroyo did in her last two years? That, like Arroyo, you can practically do whatever you want with our monies, since these are "savings"?
The reason why people trust Aquino more than Arroyo is, again the perception that he is different and he wants nothing more than pursue the welfare of the Nation. With this statement yesterday, what do you think? That Aquino is no different from Arroyo then.
Obviously, safeguards have been set by Congress so that the use of these funds would be "legal" and "just". When this administration tries to justify the illegal use of these savings, it appears that this administration is showing its arrogance, not a good thing.
This is the time for the palace to explain things in a most rational and most effective way. Emotions are high against misuse of public funds, yes? Then de-escalate.
