Where is the "berdugo' of Central Luzon, that braggart, retired General Jovito Palparan? After attempting to leave the country a few days ago, and bragging that he will face the criminal charges filed against him squarely, the puny Berdugo just suddenly disappeared? A warrant for his arrest has been issued by a Bulacan court.

Mr. Palparan, don't tell me you're afraid of the courts? You're not afraid of ordering the killing of innocent civilians and torturing several others, right? Then, quo vadis?

If you happen to see him at Glorietta or Ayala Malls (sources told me he frequents the place), there is what we call a "citizen's arrest". 


An ordinary citizen is empowered by law to arrest anyone "committing or has committed a crime" or "those with pending warrant of arrest".


It would probably be extremely good material if somebody arrest this demon cum budding dictator and lead him to jail. 


He's about 5'4 in height, slim, with always two burly security guards along with him. 


For those who gives him succor, I advised you not. Aiding or abetting a criminal or a fugitive is a crime.

Corona will crown his term as CJ with a humiliating impeachment

Had former Supreme Court Chief Justice Renato Corona heeded the pleas of everyone for him to inhibit himself in taking part in cases where his former principal, former president Gloria Arroyo was involved, he would have survived a humiliating impeachment.

Nineteen cases involving Arroyo were decided, with the active participation of Corona, with him favoring Gloria.  Legal luminaries have noted the pattern of Corona's voting. During his time as Justice of the Supreme Court, Corona voted all in favor of Gloria particularly in very sensitive and controversial cases.

Aside from this, there are very questionable transactions involving Corona. One of these, is the purchase of a 300 plus square meter property in a Pasig condominium. 

That's why many are convinced that the Chief Justice has been politicized, the institution compromised. 

But let us not heap the blame solely on Corona.

This politicization of the Supreme Court began during the time of former Chief Justice Davide. Davide was the first Justice of this court who compromised its integrity in exchange for political accommodation.

Davide started issuing very controversial interpretations of the Law favoring Arroyo. One of these startling errors was the decision to legalize the "constructive resignation" of former president Joseph Estrada. 

In all three branches of government, the Supreme Court is supposed to be the strongest institution. It represents the voice of the People, being the Constitutional body tasked in interpreting the Will of the Filipino People reflected in its laws.

What happened during the past few years was a Supreme Court expressing the Will of the ruling clique of the elite, the existing administration, not of the People's as reflected in the Constitution and the laws and previous decisions of the same court.

The Supreme Court has prostituted itself. The Supreme Court was turned into a Court ruled by big law firms.

Corona has called for the protection of the judiciary "against its enemies".

Who prostituted this court? Who smeared its hallowed name? Who turned this Court into the funniest court in Philippine History?

Why will you follow this Chief Justice who ran this Court like a jester of an Enchanted Kingdom?

Arroyo goes straight to jail

Dado Arroyo dished out a mouthful in a hastily called presscon at St. Luke's hospital. He defended his mother. He asked for sympathy, even used his kids to get it. Dado says that his family is suffering because his mother is deathly sick. The Arroyos will not leave the country. The family will face the charges squarely. And what's hurtful, Dado says, they as a family continue to get brickbats from the public.


Of course, expect potshots against your family, Dado, because you want to again fool us and pull our legs. You want us to sympathize with your mother, when your mother refuses to tell us her exact medical condition. How can we empathize with you when all of you are patently lying?


It is evident that you and your family wants your mother to escape detention. 


For many years, thousands suffered during her 9-year rule. It is now time for her to suffer the way we did.

Filipino People: Home Alone

Former president Gloria Arroyo accused President Noynoy Aquino of  being an "absentee" president. She says Aquino's "nobody's home" style of leadership has affected the economy of the Philippines. The former Chief Executive boasted of her "economic gains". Arroyo even bruited her strong leadership style which protected the economy from the financial stresses of the late 2000.


Arroyo criticized Aquino for the underperformance of the economy. Arroyo's rejoinder came out shortly after the PCCI gave a scathing remark against the Aquino administration, giving the administration a very low mark in terms of economic performance.


Bull. Crap.


Factually, both are "absentee" presidents. Both are equally galling in claiming successes or victories for and on behalf of the people. The fact remains--the majority of the Filipino People continues to wallow in dire poverty due to rising prices of commodities, particularly gas and food prices.


For one, there is overwhelming evidence of Arroyo and her associates pulling this economy to the ground with their wanton disregard of morality and law. Her involvement in onerous contracts and graft-laded projects have put great stress upon the economy, with debts ballooning to trillions of pesos. Worst, Arroyo's term was a game changer. It institutionalized cronyism, and graft and corruption. All political institutions were corrupted and became part of Arroyo's personal fiefdom. 




Sad though that the one-year old Aquino administration is showing signs of an Arroyo administration. Former Archbishop Oscar Cruz says that the only accomplishment of the Aquino administration is the enforcement of the anti-"wang-wang" campaign. Rampant graft and corruption continues unabated, with very close associates of the President involved. Erring officials in the Aquino Cabinet remained, protected by a President who is now very isolated by contending groups within.

“With pomp and pageantry, the present government took over. It is now anybody’s guess what the forthcoming SONA (State of the Nation Address) will say-and what will the people in turn say thereafter. The following is predictable: Grand accomplishment report. Miserable reality show. And that’s it. And this is no guess,” Cruz said.

Compared with the glare of Arroyo though, Aquino is doing much less. That glare of corruption has blinded most of those close to Arroyo, blinded by so much stolen monies. Aquino, meanwhile, continues to correct the monumental wrongs committed by Arroyo. Yet, both do not understand the real situation; hence, continues to commit the same wrongs of the past. 


There is promise however, in Aquino. Aquino has to give up his cronies this early. 


Fire PCSO chairman Margie Juico with her whole board. Same goes to LTO chief Virgie Torres, Customs Chief Angelito Alvarez and others who continue to shame the administration with their acts. 

Apology

Brigadier General Danilo Lim says that there's nothing to apologize for. Lim says that the proclamation order which President Benigno Aquino III wrote says nothing of apologies. A comment which the Palace issued says that for Lim and the others to qualify for amnesty, they have to apologize for trying to oust the previous administration. 


What is to apologize for? Apologies are given only by those who really committed wrongdoing. Is it wrong to militate against an immoral and illegitimate government? No. It is well within the rights of individuals. It is dictated by our consciences as Filipinos that we always rise up whenever a government oppresses the people with its policies and when the very same government pursues an elitist democracy rather than open democracy.


The blood that flows within our veins always tell us that when we see oppression, when we see immorality and when we experience the effects of mis-governance coupled with graft and corruption, we never allow such things to happen. As Filipinos, it is in our nature that we fight off corrupt men and women occupying sensitive positions in government. 


Lim and the rest of those who militated against the previous administration need not apologize. It should be the other way around--Gloria and her bunch of barung-clad thieves should apologize, nay, even, punished for their wrongdoings and their large-scale thievery during these nine years. 


Gloria Arroyo and her gang should be put to jail. Gloria Arroyo should be crucified for her evil ways. There is no other form of justice left for her and her gang of misfits. Why?


Arroyo's nine year misgovernance have set back the very gains generated by previous administrations in terms of lessening poverty incidences. Our current state is such a deplorable one that we must make faster our efforts at developing the economy for the benefit of the people. People are fast losing Hope, Mr. President, and it is incumbent upon all the leaders of this country, to unite behind one common agenda--that is, improving the quality of life of Filipinos. 


But before we undertake this great entreprise of re-building our Nation, we must first give the People justice. Justice is what we need. Justice is what we desire.

Good elites, bad elites

Is elitism really a scourge in this country? Not quite, says Joey de Venecia III. There are families which have carved dynasties that benefitted the people. Example would be the Binays of Makati City, the Osmenas, and other familiar names in Philippine politics.

What is contemptible, says Joey in his latest press statement, is when families such as the Arroyos dominate the political scene with impunity. Hence, says Joey, all opposition parties should repulse another attempt by the Arroyos to perpetuate themselves in power.

Okey, so what I gathered so far is, there are elites who are essentially good because they serve the people well, and there are those whose passion and desires are simply for self-aggrandizement. Accepted.

Now, I ask myself---what was the cause why families such as the Arroyos can actually perpetuate themselves in power without even, nay, feeling nauseous for doing so? Simple question nets a very simple answer--because existing laws allow them to. For those who study politics, politics is not an ethical nor a moral game. It is a game played by those whose desire is simply get and maintain themselves in power. Period. If the rules of the land say that you can actually field your wife, your brother, your sister, your mother, your father and your in-laws while you youself hold an elective post, you can do so because of the absence of an enabling law against political dynasties.

To change all of these, we must address the root cause of such---either enact an enabling law against political dynasty OR simply build transformative and responsible politics. The former is doable; the latter, we have a long way to go.

But of course, it is easy to say this, given that we are just saying what is possible or doable and what are not doables.

The next question that we need to answer is this---are our elites desire to simply do what is right? Probably, no. As I said, politics is not and will never be ethical simply because the way to power is not a moral struggle.

If the elites don't desire to correct the wrongs wrought by their inability to create or craft an enabling law, then, the only way to do this is eradicate the very system they use to perpetuate themselves in power. This is doable but possible, no. For the very levers of the system prevent outsiders from actually causing a breakdown of the system.

One example would be the process of elections. Elections is designed as the democratic means towards equalizing the political spectrum. How can elections be used as an effective deterrent against political dynasties when it is not as credible as we hope it is?

There are, however, models that counter this, one of which is what happened in Isabela, where Grace Padaca defeated the Dys. Or that of Pampanga when a priest, Ed Panlilio, gave the Lapids and the jueteng lords some beating. These models are, of course, local, not national. Will there be a time when nationally accepted political dynastic families crumble against weaker opponents? Possibly not doable under a self-perpetuating system of political patronage.

Noon, nag-asta pang motorcycle rider for change. Yun pala motorcycle rider for loose change.

Masamang sabihin dahil kaibigan ko ang kanyang anak, pero, nagkaroon kaya ng pag-uusap sa pagitan ni David at Gloria? Batid nating magkaibigan ang dalawang pamilya bago magkasira.

Magkano kaya...o ano kayang posisyon ang kapalit?

Talagang ace hole talaga itong mga ito. Komunista na ba kung magpahayag ng disgust sa marangyang pagkain ng mga Arroyo sa isang restaurant sa New York?

Pagiging Komunista na bang matatawag kung punahin si Mrs. Arroyo na talikdan ang mga investments nito sa stock market at hilingin na mag divest siya ng mga interes sa negosyo dahil sa conflict of interest?

Komunista na ba kung punahin ng karamihan ang kawalang interes ng pamahalaang Arroyo na bakahin ang mga tiwali sa kanyang gobyerno?

At komunista na bang matatawag yaong nagagalit sa panay-panay na pagtataas ng presyo ng langis at kawalang ngipin ni Energy secretary Angelo Reyes na tutulan ang hindi makatarungang ginagawa ng mga dambuhalang oil companies?

Katalampalasanang matatawag ang astang ito ng Palasyo. Tunay na manhid sa damdamin at kalagayan ng taumbayan ang mga taong ito sa gobyernong Arroyo.

Kung ang pagmamahal sa Inang bayan ay komunismo. Kung ang paniniwala sa katarungan at katotohanan at komunismo. Kung ang pagsandig sa Tama at pag-iwas sa katiwalian at kamalian ay komunismo, siguro nga, ako, sampu ng libo-libong Pilipino dito sa internet ay mga komunista.

Hindi daw takot ang Malacanang sa dami ng taong dumalo sa funeral march para kay Pangulong Cory Aquino noong Miyerkoles.

Sabi ni Presidential spokesperson LoreLIE Fajardo, hindi daw takot si Mrs. Arroyo dahil pagpapakita lang daw yun ng malaking pagmamahal ng mga tao sa dating pangulo.

Yun daw milyun-milyong dumating duon ay hindi daw banta sa masama at mala demonyong rehimen ni Arroyo. Patuloy daw silang mamumuno sa gobyerno.

Asa ka pa Lorelie. darating din ang araw, at malapit na malapit na, na tatapusin na ng taumbayan ang kasamaan, kabulukan at kabalintunaan na simbolo ng pamamahala ng boss mo. Gising na ang taumbayan at lahat kami, gusto na ng kabutihan. Sa pagkamatay ni Cory, umuusbong na ang puwersa ng demokrasya.

Cojuangco is True Philippine Shaker

San Miguel Corporation, led by former Marcos crony Eduardo Danding Cojuangco just entrenched themselves deeper into Lopez territory. Cojuangco is poised to take over Meralco, the Lopezes' crown jewel. Analysts say Cojuangco may do this anytime he wants to. Cojuangco's trusted lieutenant Mon Ang just assured the Lopez family that they will not be left holding an empty bag since they could still nominate a member of their family to the board of Directors of Meralco.



Aside from the Lopezes, the Ayalas are now being threatened by the rising influence and presence of San Miguel in other industries. San Miguel just joined the telecommunications industry with the acquisition of Liberty Telecommunications and a joint beneficial partnership with Qatar Telecomms. That move made San Miguel easily the second biggest telecommunications firm, eclipsing even Globe Telecommunications. The move was so good and so swift, it left Gerard Ablaza clueless for months.



San Miguel also entered the energy sector industry, with the majority takeover of Petron. San Miguel also brought a majority interest in the power generation sector.



So, you see, my friends, San Miguel is the biggest business conglomerate in this country, controlling almost all levers of economic life and enjoying the biggest and the widest economic influence not seen since the 19th century.



Now, Cojuangco knows that one wrong move could dissipate all of these things. His rivals will never equal his business acumen.



The only way left for Cojuangco's jealous rivals to dislodge him as the Country's Shaker Giant is simple---launch a coup. Only a coup can change the present political and business configurations. Elections are so unwieldy, so costly and so unpredictable that some businessmen rivals of Cojuangco are thinking of another alternative.



Being a pragmatist though, Cojuangco knows that all of these things are temporary since his bosom protectors, Gloria Macapagal-Arroyo and her very accommodating businessman husband, Mike Arroyo are leaving in a few months time.



An unfriendly government post-2010 is a very serious security threat to him and his San Miguel. That's why he'll make the heavens quake and the earth shake with a candidate that could preserve the gains of San Miguel.



Enter Cheez Escudero and Loren Legarda, two of Cojuangco's bets for the top executive posts. Now, what would frustrate Cojuangco's plans?



A coup. A true revolution.



This explains why those " RAM boys" were seen with Gloria at the EDSA Uno celebrations. They'll now poised as a "counter-revolutionary" force against the True Patriots of the New Generation.



Let me re-phrase what I wrote some entries ago--they are not there as Gloria's praetorian guards. No.



They were there to ensure that Gloria finishes her term. If a coup happens and ousts Gloria from power, Cojuangco is sure to follow. Ika nga, naging magkapusod na ang dalawa--isa taga Tarlac, isa naman Pampanga.



Maybe, a coup will be used here in the Philippines as a business tool rather than a political tool. Will we see this in our lifetime? Maybe. Maybe not. Let's see in the coming weeks.

Fears allayed

For those who want to get a clearer understanding of things happening right now, these are just some of the things you must expect in the coming weeks.

1. WE WILL HAVE A PRESIDENTIAL AND LOCAL ELECTIONS IN 2010. CHARTER CHANGE IS BOUND TO FAIL THIS YEAR AND EVEN IN 2009.

2. WHETHER GLORIA GETS BOOTED OUT THIS WEEK OR THE NEXT OR EVEN NEXT YEAR, WE EXPECT TO HAVE THE SAME CONSTITUTION AND THE SAME EXPECTATION OF GOOD THINGS IN 2010.

3. EXPECT 2009 TO BE A BETTER YEAR THAN 2008. DESPITE THOSE ECONOMIC FORECASTS AND PROGNOSTINATIONS AND DOOMSDAY SCENARIO, THE PHILIPPINES WILL REMAIN STRONG. IT WILL, HOWEVER, BE STRONGER WITHOUT GLORIA AT THE HELM. DESPITE WHAT PEOPLE THINK, THAT THINGS WILL GET NASTIER AND CHAOTIC, A GOVERNMENT WITHOUT THE GLORIA GANG IS BETTER THAN A GLORIA LED GOVERNMENT IN 2009. EXPECT SWEEPING CHANGES WITH LASTING REPERCUSSIONS. EXPECT A CLEANER GOVERNMENT. AND DEFINITELY, EXPECT PERSONALITIES LIKE BAYANI FERNANDO FADING INTO OBLIVION AND EARLY RETIREMENT. THOSE WITH PULBURA MENTALITY AND ABUSIVE TACTICS WILL BE FORCED TO GET THEIR THINGS PACKED AND READY TO GO. BECAUSE THE WAVES OF CHANGE ARE NOW CAUSING A TSUNAMI AND SENDING HEARTS IN PANIC MODE IN MALACANANG.

Analysis of the Phil. Situation 3: The Political Bigwigs

There are talks that Speaker Prospero Nograles is under extreme pressure. His political party, Kampi, is pressuring him to change his stand against term extension. Kampi even threatens to oust him as Speaker via a coup d'etat. And the one allegedly orchestrating this, is none other than his friend, Ronnie Puno.

It's well known that DILG secretary Ronnie Puno (the chief architect of Kampi's expansion) belongs to the small group of Palace secretaries who favor Gloria's 2020 overtime plan. Puno is allegedly confident that the strength of the anti charter change movement is weak, therefore, this is the time to really go for blood and push charter change down the people's throat. Obviously, a consummate politician like Nograles sees differently and that explains why he's opposing Puno's group. For all his allegedly strong personality facade, Nograles is afraid to go against his former boss, Jose de Venecia Jr. Talks are afloat within the House that JDV is getting more and more support not only from civil society but also in the political scene that there are very strong perceptions that JDV is re-invigorating his political clout. Now, aside from Nograles, Albay Congressman Edcel Lagman already called it quits and already announced his readiness not to participate in the charter change push.

Now, I think that other charter change proponents will fall one by one prior and after December 12. Luis Villafuerte will definitely accede, so do Cebu Congressman Pablo Garcia. Even La Union Congressman Victor Ortega will succumb to public pressure once this accelerates a week before December 12. If these Congressmen fall, the rest will definitely follow. Unlike the Big Yoda (Jose de Venecia Jr.), these Congressmen are not made of sterner stuff. They, surely, will enter into compromises or deals if they see that the winds are changing and blowing in the other way.

At the Senate, almost everybody there are opposed to term extensions. However, it is important to note how Enrile will maneuver to neutralize future opposition to his post as Senate President. Enrile is neither opposition nor administration. He is his own man. He may act independently on his own to solidify forces against Gloria come decision time.

Meanwhile, traditional political parties are positioning themselves away from the ruling coalition and this will definitely show come December 12. Manny Villar's Nacionalista Party has just forged a tactical alliance with the JDV-FVR faction in Lakas. Danding has also given his blessing for NPC to join JDV-FVR. Will there be a formal announcement of the breakout of this Lakas faction from the Lakas-KAMPI ruling coalition? Quite expectedly, yes. Will there be a new dominant party prior to 2010? Yes. It will be the strong political front of Lakas-NPC-Nacionalista. Will this impact on the political future of other political parties? Yes. Who is the most immediate victim? It will be Gloria's KAMPI party who will definitely be marginalized once FVR announces a tactical alliance.

Now, this announcement will definitely be timed after a strong showing against charter change in December 12. Obviously, FVR has already wrote finis his relationship with Gloria and he knows how to counter the expected backlash from Lakas-KAMPI. It would be better if FVR's faction does this after the overthrow of Gloria.

In fact, many are saying that the reason for these sudden political re-alignments is to protect the status quo once a coup succeeds in toppling Gloria. At the surface, it may appear that the December 12 interfaith rally is just your normal rally but in the backstages, things are moving very fast against Gloria. The rally is just a facade to hide the backroom negotiations being done to effect a bloodless transition of power! More on this in the summary of these posts.

Regain This Nation's Glory

Have you been asked by your mom to go to the store and buy some suka? I’m sure every one experienced that. You’re given 10 pesos and suka is just 5 pesos a jigger and you give back the sukli, yes? I know everyone experience that.

In government, the people repose trust and confidence to their leader. Elections are the surest guarantee of that trust. Elections give these officials the chance to serve and it serves as a covenant. The laws, meanwhile, serve as terms of reference, a kind of Code that guides everyone on the right conduct in society.

This simple experience of going to the store and buy something and giving back the sukli is what we call “accountability”. When you’re a government official, you need to think that every action that you take requires accountability. You are not doing it for your own benefit. You are doing it for your parents, your grandparents, your wife, your kids and your friends.

A government post is not just a position of responsibility; it is a position of accountability.
IN this administration of Mrs. Gloria Macapagal-Arroyo, she and the rest of her gang were given the chance to serve this country. Through taxes, the people express the belief that Mrs. Arroyo would uphold the very pillars by which this country was founded:

Independence
Territorial Integrity
Justice

In a span of eight years, Mrs. Arroyo has nearly destroyed all of these pillars and for what? To make the Filipino life better? Tell that to the Philippine Marines, Mrs. Arroyo. The very sons and wives of the Marines are suffering. They can’t even get their allowances. They can’t even get loans.

Is the life of the soldier better now than 2001? No. The same old boots. The same tattered clothes. The same old bullets. The same old soggy socks.

How about the worker? Is life better now than 2001? Wage increase, is there any? How about the ability to get loans? Nothing much either there.

What future awaits the Filipino farmer who were deprived of more than 3 billion pesos by a group of greedy and hungry devils masquerading as government officials?

What future awaits the more than 350,000 new graduates next year? How about the more than 7 million able-bodied Pinoys all walking like Zombies along the stretch of Ayala and all other places in the country, finding, desperately looking for jobs?

And what would happen to the more than 2 million people affected by the war in Mindanao?

This war which has been raging since the 19th century, has now affected more than 250,000 families. Prior to this year, peace has relatively reigned in that part of the world. But because of higher realpolitik, peace and order has now degenerated.

Who, then, is accountable for all these societal mess?

If this government cannot give us justice, then, let the People show everyone that this Country is still proud of its race.

Thrice Spurned

To Mrs. Gloria Macapagal-Arroyo,

Please discontinue embarrassing us. You called President-elect Barack Obama thrice, yet, the good president of the United States of America, an important ally, rejected your calls. I can even hear the voice from the other line, " your call cannot be completed as dialed...please check the number and dial again.." Hehehe!

Other world leaders have already called Obama and he already accepted their thanks. But you, oh, Obama will never spend his precious time with you.

Obama hates human rights violators.
Obama hates those who are greedy for power.
Obama hates oppressors.

And you know what? I'm very, very close to Obama through the Internet, you see. In fact, since 2003, I've known him thru email and web correspondences. He's a very nice and enviable guy. And he responds thru chat.

And you know why he prefers to talk to a guy like me, and millions of us?

Because we're not power-hungry.
Because we're not greedy.
Because we respect the rights of our fellow men.

The moment Gloria realizes that she's actually not running our country the way it should be run, she'll know why Obama hates her so much.

The Arroyo government stands to lose future US government assistance due to its worsening corruption record, Senator Mar Roxas warned Saturday.

According to a report recently released by the Washington-based think-tank, Center for Global Development, the Philippines, for the first time in three years, failed this year the "control of corruption" indicator set by the US-funded Millennium Challenge Corp.

Most of us disagree with ousting this government prior to 2010, but if we continue having a government like this, how would we be able to say that we can weather the global financial storm, having a government such as this, controlling our affairs?

Corruption is just one of the worsening problems. More disturbing is the obvious fact that government has this propensity to bend the law, as a capricious way of getting what they want. With the palace having control over literally all levers of power, how would we possibly fight this scourge that's costing us billions of pesos? 

Do we still need a foreign think-tank group to show us how corrupt our government is right now?

The Blue Barbie

The Inquirer just posted this today. Unknown to the media handlers of Madame Gloria, this is an embarrassing photo for the illegitimate president. I don't love Gloria. It's just that the OPS should have asked the Inquirer to "tone down" this photo. Remember, Gloria, whatever we think about her, she is still the head of State. She represents the Office of the President. And last thing I remember, I'm still a Filipino citizen.

Gloria looked like a Blue Barbie doll in this photo.

I know what the Inquirer is trying to say---that Gloria is above everything. Well, they should have been more responsible. I know Barbie lives with Ken in Barbieland. And with the World Bank denying Gloria's dream US$10 billion ASEAN fund, we may probably live as Barbie and Ken do in dreamy Enchanted Kingdom.

On October 17, 2008, the Hultman family will be commemorating the death anniversary of their daughter Maureen. In 1991, sixteen year old Maureen was brutally murdered by Claudio Teehankee Jr. Teehankee shot her in the head, while in the company of her friends. One of the victims survived and testified against Teehankee Jr. After 90 days, Maureen died due to the bullet wound she sustained in the head.

In 1995, Judge Joe Madayag sentenced Teehankee to life imprisonment. The son of the former Philippine Supreme Court Chief Justice received two life sentences and another one for frustrated homicide. Based on the Revised Penal Code of the Philippines, Teehankee should serve at least 40 years incarceration.

In 2008, the Hultmans and the rest of the Filipino People were shocked when Philippine president Gloria Macapagal-Arroyo granted executive clemency to Teehankee. Speculations point to the reported closeness of Arroyo to the sister and brother of the convicted killer. Philippine Justice secretary Raul Gonzales was quick to defend the decision of Mrs. Arroyo, along with Executive Secretary Eduardo Ermita. Both said that Teehankee has served his due and eligible for clemency.

A quick look at the laws says that a convict can only be eligible for pardon if he already served 30 years imprisonment and if the convict already reached the age of 70.

Teehankee has just served less than 20 years and he's only 62 years old. Therefore, the convicted killer is still not eligible for executive clemency.

It is clear that the decision of Arroyo has no basis in law and therefore, can be considered as a capricious abuse of her executive powers as president.

We, therefore, ask all Filipinos everywhere to support this Petition. The petition ask that:

1. Give Justice for the Hultman family through a review of the executive clemency granted by Arroyo to Teehankee.

2. Petition for the immediate arrest and re-detention of Teehankee so that he continues to serve the remainder of his sentence.

3. Justice for all victims of violence, heinous crimes and human rights violations in the Philippines.

4. Ask the International Community to help the Filipino People end the capricious rule of Mrs. Arroyo and her Mafia gang of gutless officials through a People's Revolt.

5. Regain Truth, Justice and Peace that have been trampled upon by Mrs. Arroyo and her Gang of Misfits.

Power to pardon abused by Gloria?

Before I continue writing about the Bangsamoro Question, let me digress a little bit and talk about the Claudio Teehankee Jr. controversy.

Teehankee Jr. is supposed to serve at least twenty years in prison. He was meted a double life sentence which means that incarceration should be at the maximum forty years. He could be eligible to a commutation of sentence for good behavior but, under our laws, he should at least serve a majority of the sentence.

In this present issue, Teehankee has not served the majority of his sentence. Therefore, he must still remain in jail.

Gloria, acting as president, commuted his sentence and eventually reduced to zero the years Teehankee is supposed to serve. Malacanang defended Gloria's action, saying that the president has the absolute right to grant pardon and nobody can question it. I post a demurrer.

The Supreme Court can question the circumstances behind the grant of parole but not the legality or the constitutionality of it. The President has the power to grant paroles. However, lest the president be accused of abusing her powers, parole granted must satisfy the requirements of law. Even the president has to bow down to the law.

And this lies the core question--did the president abused her parole powers? In this case, yes. Obviously, Gloria was pressured probably by Manual Teehankee, the brother of Claudio Jr. Or, granting that she was'nt, there's no basis for the grant of pardon, since she should have reviewed the case file thoroughly before making that decision.

Having said that, this case is a classic example of how people occupying the halls of power abuse their powers for their personal or friend's sake. Mayor Lim is right--the law has to favor no one or "no law at all".

And this reminds us how Gloria thinks and acts. The high and mighty really thinks that she's all-powerful, even to bend the laws of the land.

MERALCO the big mafiosi boss should be stopped right now!

Meralco, that behemoth of a power utility firm, is at it again. The Lopez-controlled firm has just announced a rate hike. They want Filipinos living in the Metropolis to give them 5 pesos more per kilowatt-hour of electricity. The reason for the power hike, so they say, is the shortage of electric distribution, which, in the words of Meralco PR boss Elpi Cuna, force their company to again, hike prices. Cuna says Meralco will again suffer from public outrage since the hike will be blamed to them. " It's not our fault", says Cuna. "..it's the fault of government." Or, specifically, the PSALM.

Besides, at the Senate energy committee probe today, Meralco admitted not knowing what's the correct charge to their customers. Without saying outright, Meralco says they may or may not be charging the right rate to us. If they don't know their math, they don't deserve being our distribution company.

I don't know about you but I'm sick and tired of Meralco's oft-repeated refrain of having losses "in the service of the Filipino." I mean, we are being fooled by this Lopez-controlled firm for the longest time. Senator Miriam Santiago is right--if the company is losing millions or even billions, the firm should probably decide to give over the reins of management to other groups (read: GSIS). There's something wrong with how Meralco is being run and government should step in to change the situation.

Yeah, yeah, I know, I know. This would probably surprise a lot of my friends, since at the onset of the GSIS vs. Meralco war, I made a stand against GSIS simply because Winston Garcia is doing it the wrong way. Now that he has momentarily desisted from his foolish enterprise, and Meralco again acted like a big mafiosi boss, it's time for government to intervene for the sake of the suffering consumers.

Since Gloria has failed to leave a legacy on the peace process in Mindanao, maybe it's time for the illegitimate president to focus on alleviating the plight of the Filipino masses by intervening in this case. Meralco continues to abuse the confidence of its customers and it is time for government to intervene.

Malacanang should start by revoking the franchise of Meralco. Gloria has the power to do that. If Meralco balks and goes to the Supreme Court, then, sige, allow them to do so. Or, better yet, Gloria should use the full force of the law and takeover Meralco. My, this utility firm is causing so much harm to the public welfare that everybody will applaud her for doing so.

It's time to change the policies of this distribution giant and give the reins of management to another who understands what Filipinos are experiencing. Look, Meralco's charges comprise at least 45% of the monthly pay of an ordinary Filipino worker and this is toooo much! I will support Gloria and even kiss her puny face should she win against Meralco.

The Last Option

There is a very serious and life-threatening situation for Filipinos now. And I urge everyone who reads this to be very, very vigilant because I am sensing something very sinister that would happen either this month, August or in the coming two months.

I am talking about the worsening Mindanao conflict. This conflict is just part of a bigger scenario to create instability. I am not into this conspiracy crap, but, the way things are going right now point to this direction. 

There is a plan for the immediate ouster of Gloria by way of a coup. Reports point to two groups involved. One is a group within the palace who wants to extend their political life post-Gloria and the other, a more cohesive movement, supported by international players who aim to sacrifice Gloria's administration to preserve the so-called Philippine territory.

Both groups are antithetical to the widespread clamour for meaningful change. Both belong to the rightist side of the political spectrum, although one of them is being supported by cause-minded people in high society as well as civil society. 

It seems that people from both groups want to escalate the violence to a certain degree as to create temporary instability, without much bloodshed and without much impact to the national economy. Indications point to a heightening of tensions prior to August 15 (the date when the Supreme Court hears arguments for and against the MOA) and beyond August 18, 2008. Before the Supreme Court releases a favorable decision on the MOA, either one of these groups will act against this administration. 

A proposed deterrent is for this administration to abandon federalist talk and shift the burden of resolving the Bangsamoro Question to the next administration. Or, this government should also  institute immediate security measures to avert a possible God Save the Queen plan or another Oakwood mutiny.

There are signs that people with sinister plans will foment a revolt or mutiny within the AFP and the PNP. As casualties mount with the on-going military offensive in North Cotabato, that would be the sign that these groups will wait to launch an offensive against Gloria. 

Either way, Gloria is a sure loser in this intra-elite fighting. There's really something behind that cryptic FVR statement that Gloria's term is sure to be continued by another (possibly the SC Chief Justice) and she'll not enjoy immunity.
